⚖️ TERMS & CONDITIONS (T&C)

1. Introduction

These Terms and Conditions govern all shops registered on Mzansi Online Mall, an online marketplace and e-commerce management platform operated by FreshCheck Monitors (Pty) Ltd (“the Company”).

By registering a shop or business, you (“the Shop” or “the Owner”) agree to comply fully with the terms and conditions set out below.

2. Verification & Security

All shops must complete verification before being made public on Mzansi Online Mall.

Verification requires submission of:

• A CIPC registration certificate or business trading permit, or
• A sworn affidavit, certified copy of ID, and a photo of the owner holding their ID (for informal traders).

Any false or misleading information will result in immediate suspension or permanent removal from the platform.

When a shop changes ownership or management, updated verification documents must be resubmitted for approval.

3. Shop Access & Passwords

Only verified managers or shop owners are authorized to access the shop dashboard.

If management changes, the previous password must be reset immediately.

FreshCheck Monitors may request proof (e.g., affidavit or official letter) confirming the management change before reissuing access.

Lost or forgotten passwords will only be reset after full identity verification is completed.

4. Subscription & Payments

Subscription fees are charged according to the selected plan:

• Basic Plan: R250/month
• Standard Plan: R750/month
• Premium Plan: R1,500/month

Shops may choose monthly or annual payment options.

Payments are non-refundable.

Proof of payment must be uploaded on the platform or sent via WhatsApp to the company.

Failure to pay will result in automatic suspension of the shop account.

5. Data Protection

FreshCheck Monitors fully complies with the Protection of Personal Information Act (POPIA).

All verification documents (IDs, certificates, affidavits) are encrypted and securely stored.

Data is used only for verification and internal compliance — never sold or shared with third parties without written consent.

6. Product Listing

• Shops must ensure that all products listed are legal, accurately described, and priced fairly.
• The sale of counterfeit, illegal, or prohibited goods is strictly forbidden.
• Out-of-stock items must be marked “Out of Stock” or hidden from the public.
• Shops must clearly show “Price Was / Price Now” when running promotions or discounts.
• Stock quantities must be updated regularly.

7. Liability

• Mzansi Online Mall and FreshCheck Monitors act solely as a digital marketplace and advertising platform.
• The Company is not responsible for disputes, losses, or damages between buyers and sellers.
• Deliveries, refunds, or exchanges are handled directly by the shop.
• The Company does not guarantee transactions and cannot be held liable for non-payment or fraud by customers.

8. Termination of Access

• FreshCheck Monitors reserves the right to suspend or terminate any shop account found violating these terms.
• Suspended shops must reapply with updated documents and a valid payment.
• Reinstatement is subject to Company review and approval.

9. Legal Framework

• This agreement is governed by the laws of the Republic of South Africa.
• All disputes shall be resolved in the Bloemfontein Magistrate Court, Free State Province.
